Dalmiya case 'closed for order'

The stage is set for judgment day in the misappropriation of funds case involving former Board of Control for Cricket in India president Jagmohan Dalmiya after he failed to appear before the Board's disciplinary committee in Mohali on Sunday.

The committee had summoned Dalmiya, who is also president of the Cricket Association of Bengal, to the PCA stadium in Mohali, but he failed to turn up.

BCCI secretary Niranjan Shah, in a statement, said the committee, which met at the PCA stadium on Sunday morning, considered Dalmiya's action as a delaying tactic and decided that the matter be "closed for order".

The committee will submit its report to the secretary.

"Dalmiya was issued notice to appear before the Disciplinary Committee on two earlier occasions. On 17th of July 2006 he was asked to appear before the committee on 26th July 2006. However a request was made by Dalmiya to defer the matter as he was approaching the Civil Court at Kolkata challenging the show cause notice. The matter was therefore adjourned," Shah said.

"Dalmiya was again issued a notice on 31st July 2006 asking him to appear before the Disciplinary Committee on 15th of August 2006. Dalmiya challenged the notice before the court and the court had directed Dalmiya to submit his detailed reply by 3rd of October 2006 and to appear before the Disciplinary Committee 7 days thereafter.

"The Board had asked Dalmiya to appear before the Disciplinary Committee today. However, Dalmiya failed to appear," he added.

The committee "felt that the endeavour of Jagmohan Dalmiya is to prolong the proceedings and not co-operate with the Disciplinary Committee", hence it decided to proceed ex-parte in the matter.

"At the meeting, the Disciplinary committee recorded the statements of witnesses and took on record the documents produced by the Hony. Treasurer of BCCI, N Srinivasan, and have closed the matter for order.

"The report of the disciplinary committee would be submitted to the Board's secretary."
