A sessions court on Monday deferred until August 28 the bail plea of former police commissioner R D Tyagi, even as the prosecution said that it would file within a week a charge sheet against him and 17 others.
They are accused of murdering nine Muslims during the 1993 Bombay riots.
Tyagi did not press for his liberty before Judge A M Thipsay in view of a statement made by state's counsel P R Vakil that a charge sheet would be filed against him and 17 cops by August 27, as they were awaiting sanction to prosecute them.
Tyagi's counsel Ashok Mundargi submitted that in view of this statement he would prefer to argue the bail plea of Tyagi only thereafter.
Mundargi harped on Tyagi's health and parity in law to seek his liberty. He said Tyagi was convalescing in Bombay Hospital while the other co-accused had sought anticipatory bail from the court. They were arrested and granted bail but Tyagi continued to be in custody, he added.
Advocate Nilofer Bhagwat filed an intervention petition on behalf of a relative of a victim killed in police firing allegedly ordered by Tyagi at Suleman Bakery on January 9, 1993.
She opposed Tyagi's bail and cited several judgements to support her case of intervention.
The counsel for Tyagi and state, Mundargi and Vakil, opposed the intervention petition on legal grounds. They also said that nine persons had died in the firing and if the court permitted the relative of one victim, others would follow suit.
