Former Bombay police commissioner R D Tyagi, who was indicted by the Srikrishna Commission in the 1992-93 riots case, was on Wednesday denied bail by Justice A B Palkar.
The Special Task Force appointed by the Maharashtra government to implement recommendations of the Commission had filed a First Information Report against Tyagi in May this year.
Passing the order, Justice Palkar said that Tyagi could appeal in the Supreme Court against the judgment and has directed the Bombay police not to arrest him before August 8.
R D Tyagi was accused of leading a police team that killed nine people at Suleman Bakery during the infamous Bombay riots of 1992-93.
"This is one incident where the police appeared to be utterly trigger-happy and used force utterly disproportionate," wrote Justice Srikrishna in his report.
"The responsibility for this incident must squarely fall on Joint Commissioner of Police R D Tyagi who was overall in charge of the operation," Justice Srikrishna noted.
Based on the findings, the Srikrishna Commission strongly recommended that the government take strict action against Tyagi and two junior police colleagues for the Suleman Bakery deaths.
